These specific terms and conditions (“Service Specific Terms”) apply in relation to the provision of the Service by Etisalat by e& to the Customer and must be read in conjunction with the other constituent parts of the Agreement between Etisalat by e& and the Customer. The Service is available to individuals and shall be governed, in addition to these special terms, by the General T&Cs (Consumers).
Any capitalized terms that are not defined in this Clause 2 have the meaning given to them in the General T&Cs of (Consumer).
a. Agreement
Means the entire contractual agreement between Etisalat by e& and the Customer, comprising the constituent parts set out in Clause 3 of the General T&Cs (Consumer).
b. Customer
Means any person who purchases or subscribes to the Service.
c. Etisalat by e&
Means Emirates Telecommunications Group Company P.J.S.C.
d. General T&Cs (Consumer)
Means Etisalat by e&’s general terms and conditions applicable to individuals signing up to the Service as published on Etisalat by e&’s website and as available through the other communications channels referred to in Clause 30 of the General T&Cs (Consumer).
e. Minimum Term
has the meaning given to it in Clause 4(b).
f. Service
Means the postpaid mobile broadband service made available under the name ‘Etisalat by e& Home Wireless’ by Etisalat by e&, as described in more details in Clause 3.
a. The Service is a postpaid mobile broadband data service, which a Customer may make use of by using a SIM card issued by Etisalat by e& in any device that supports mobile broadband. Voice, SMS and MMS services are not available and are not compatible with the Service.
b. The Service is available only at the Customer’s residential premises (Home Location). The Home Location of the Customer will be determined upon the activation of the SIM Card by Etisalat by e&’s mobile network.
c. Customer can relocate the Sim Card one time in a single month with no extra charge by calling 101 (subsequent moves will be charged AED100 per instance).
d. The mobile broadband data allowance available to a Customer depends on the tariff plan to which the Customer has subscribed to in the Service Application Form (the “Tariff Plan”). The data allowance must be utilized within a billing cycle and any unused data allowance will not be carried forward to subsequent billing cycles.
e. Customer will receive a STARZPLAY voucher by email based on his subscription plan, at the Customer’s email address that is associated with his profile in Etisalat by e&. The voucher can be redeemed by the Customer at the STARZPLAY app or webpage.
Subscription Plans:
(a) 12 Months subscription if he subscribes to home wireless 4G plan
(b) 24 Months subscriptions if he subscribes to home wireless 5G plan
(c) If the Customer subscribes to etisalat home wireless 4G plan, the Customer may opt in for a 4G router.
(d) If the Customer subscribes to etisalat home wireless 5G plan, the Customer shall receive a 5G Router as part of the service at no extra charges. Additionally, the Customer under the wireless 5G plan has the right to purchase and/or use the Customer’s own router.
a. The Agreement is valid and binding on and from the date on which it is submitted to and accepted by Etisalat by e&.
b. For Home Wireless – 4G Plan: the Service has a minimum term period of 12 months , for Home Wireless – 5G Plan: the Service has a minimum term period of 24 months (the “Minimum Term”), which starts on the date on which Etisalat by e& makes the Service available to the Customer (“Activation Date”). At the end of the Minimum Term, the Customer can continue to make use of the Service for additional terms of one month each until the Service is terminated in accordance with the Agreement.
c. In the case of Tariff Plans to which no Minimum Term applies, the Service shall be available on an indefinite monthly basis. At the end of a billing cycle, the Agreement shall be automatically renewed for additional terms of one month each until the Service is terminated in accordance with the Agreement.
Please see Clause 8 of the General T&Cs (Consumer), as applicable, for the provisions governing the Customer obligations and restrictions that apply to the Service.
Etisalat by e& will provide the Service to the Customer based on these Service Specific Terms together with the other constituent parts of the Agreement, and in accordance with the law.
a. The monthly rental fees will all be computed on a pro rata basis from the Activation Date until the date of the first bill. Thereafter, starting from the first bill cycle, the full monthly rental will apply and Customers will be given all the included data units in the package.
b. If the Service is terminated part way through any month, the bill covering the final billing period will cover the entire month during which the Service was terminated and will not be computed on a pro rata basis from the date of termination until the date of the end of the billing cycle (i.e. the Customer will be charged the full monthly rental).
c. Please see Clause 15 of the General T&Cs (Consumer) as applicable, for the other charges, billing and payment provisions that apply to the Service.
d. For home wireless 4G Plan: The promotion price (AED 199) is valid for 12 months after which the full price will apply (AED 299 per month) by notifying the customer through Etisalat by e&’s communication channels and obtaining his/her explicit consent. For home wireless 5G Plan: The promotion price (AED 299) is valid for 24 months after which the full price will apply (AED 399 per month) by notifying the Customer through Etisalat by e&’s communication channels and obtaining his/her explicit consent.
a. Transfer of ownership is not allowed.
b. A request from the Customer to migrate a Service account or vary their subscription to the Service shall be deemed to be an authorization to Etisalat by e& to transfer all of the Customer’s credits, dues and obligations in relation to the Service to the new account or to apply them to the varied subscription.
c. Please see Clause 16 of the General T&Cs (Consumer) as applicable, for the other customer credit, advance payment and deposit provisions that apply to the Service.
Please see Clause 19 of the General T&Cs (Consumer) as applicable, for the provisions governing the suspension, disconnection and termination of the Service or the Agreement by Etisalat by e&.
a. If the Customer wants to terminate the Service, he/ she must give Etisalat by e& prior written notice.
b. Where the Customer has selected a Service plan with a Minimum Term and terminates the Service before the expiry of this Minimum Term, the Customer shall pay an early termination charge, which shall amount to AED 1,000 or one undiscounted monthly rental charge, which amounts to AED 299 for the 4G subscription plan and AED399 for the 5G subscription plan, of the current Service plan (whichever is the lower) and shall pay for the 4G or 5G Router as per the following calculation:
( Rp / Ct ) x ( Ct – ( 1 + T ) )
Rp = the retail price of the device(s);
Ct = the number of months in the minimum term of the contract; and
T = the number of months the subscriber has served in the contract.
c. Penalty-Free Service Cancellation Period: The Customer may, subject to certain conditions being met, cancel the home wireless 4G plan within 3 days in case that the Customer opted out from receiving a router, the home wireless 4G plan within 7 days in case the Customer opted in to receive a router, the home wireless 5G plan within 14 days and etisalat by e& will waive the exit charges and/or equipment charges as applicable. The router is to be returned to etisalat by e& with all accessories and documentation in the original packaging. The Customer can return the 4G or 5G router, as the case may be, by calling “101” or “800101” to request etisalat by e& agents to collect the router.
d. If at any time the Customer cannot be connected to a 5G network, the Customer will be automatically connected to a 4G network.
e. In the event that the Customer who has subscribed to the wireless 5G plan is unable to get 5G coverage, the customer may cancel the Service without any exit charges.
The Customer acknowledges that the Service is subject to a ‘Fair Use Policy’ and the following restrictions and / or limitations to the use of the Service and any add-on services: Etisalat by e& reserves the right to throttle the speed of the Service to 1mbps on either of the plans: if the Customer exceeds usage of 300GB in a month on his etisalat by e& home wireless 4G plan or exceeds usage of 1000GB in a month on his etisalat by e& home wireless 5G plan. Multi-sim is not allowed for this service.
The Customer may contact Etisalat by e& to discuss the Service (including these Service Specific Terms and the General T&Cs (Consumer) or any other product or service offered by Etisalat by e&, by using any of the communications channels stated in Clause 30 of the General T&Cs (Consumer).
Please see Clause (32) of the General T&Cs (Consumer) as applicable, for the provisions governing Value Added Tax (VAT) that apply to the Service.
