These specific terms and conditions (these “Service Specific Terms”) apply in relation to the provision of the Service by Etisalat to the Customer and must be read in conjunction with the other constituent parts of the Agreement between Etisalat and the Customer. The Service is available to individuals and shall be governed, in addition to these Service Specific Terms, by the General T&Cs (Consumer).
Any capitalized terms that are not defined in this Clause 2 shall have the same meaning given to them in the General T&Cs of (Consumer).
(a) “Agreement” means the entire contractual agreement between Etisalat and the Customer, comprising the constituent parts set out in Clause 3 of the General T&Cs (Consumer).
(b) “Customer” means any person who purchases or subscribes to the Service.
(c) “Etisalat” means Emirates Telecommunications Group Company P.J.S.C..
(e) “General T&Cs (Consumer)” means Etisalat’s general terms and conditions applicable to individuals signing up to the Service as published on Etisalat’s website and as available through the other communications channels referred to in Clause 30 of the General T&Cs (Consumer).
(f) “Minimum Term” has the meaning given to it in Clause 4(b).
(h) “Service” means the postpaid mobile broadband service made available under the name “Home Wireless” by Etisalat, as described in more details in Clause 3.
(a) The Service is a postpaid mobile broadband data service, which a Customer may make use of by using a SIM card issued by Etisalat in any device that supports mobile broadband. Voice, SMS and MMS services are not available and are not compatible with the Service.
(b) The Service is available only at the Customer’s residential premises (“Home Location”). The Home Location of the Customer will be determined upon the activation of the SIM card by Etisalat’s mobile network.
(c) The Customer can relocate the Sim card one time in a single month with no extra charge by calling 101 (subsequent relocations will be charged at AED 100 per move).
(d) Multi-sim is not allowed for the Service.
(e) The mobile broadband data allowance available to a Customer depends on the tariff plan (“Tariff Plan”) to which the Customer has subscribed to in the Service Application Form. The data allowance must be utilized within a billing cycle and any unused data allowance will not be carried forward to subsequent billing cycles during or after the expiry of the Minimum Term.
(f) Tariff Plans:
i. Home Wireless Advance Tariff Plan: the Customer will get unlimited data for the duration of the Minimum Term. If the Customer subscribes to the Home Wireless Advance Tariff Plan, the Customer may opt in to receive a router.
ii. Home Wireless Premium Tariff Plan: the Customer will get unlimited data for the duration of the Minimum Term. If the Customer subscribes to the Home Wireless Premium Tariff Plan, the Customer shall receive a router as part of the Service at no extra charges.
(a) The Agreement is valid and binding on and from the date on which it is submitted to and accepted by Etisalat.
(b) For Home Wireless Advance Tariff Plan: the Service has a Minimum Term of twelve (12) months. For Home Wireless Premium Tariff Plan: the Service has a Minimum Term of twenty-four (24) months (each a “Minimum Term”), which starts on the date on which Etisalat makes the Service available to the Customer (the “Activation Date”). At the end of the Minimum Term, the Customer can continue to make use of the Service for additional terms of one month each until the Service is terminated in accordance with the Agreement.
(c) In the case of plans to which no Minimum Term applies, the Service shall be available on an indefinite monthly basis. At the end of a billing cycle, the Agreement shall be automatically renewed for additional terms of one month each until the Service is terminated in accordance with the Agreement.
(d) Promotion (“Promotion”) The validity of the Promotion is three months from the date of launch of the Promotion (the “Promotion Period”).
Please see Clause 8 of the General T&Cs (Consumer), as applicable, for the provisions governing the Customer obligations and restrictions that apply in respect of the Service.
Etisalat will provide the Service to the Customer based on these Service Specific Terms together with the other constituent parts of the Agreement, and in accordance with the law.
(a) The monthly rental Charges will all be computed on a pro rata basis from the Activation Date until the date of the first bill. Thereafter, starting from the first bill cycle, the full monthly rental Charges will apply and Customers will be given all the included data units in their respective packages.
(b) If the Service is terminated part way through any month, the bill covering the final billing period will cover the entire month during which the Service was terminated and will not be computed on a pro rata basis from the date of termination until the date of the end of the billing cycle (i.e. the Customer will be charged the full monthly rental Charges).
(c) Please see Clause 15 of the General T&Cs (Consumer) as applicable, for the other Charges, billing and payment provisions that apply to the Service.
(d) Tariff Plans
i. For Customers subscribing to the Home Wireless Advance Tariff Plan: the Charges (AED 199 per month) shall be valid for the duration of the Minimum Term (i.e. twelve (12) months). After the expiry of the Minimum Term the higher Tariff Plan price shall apply (AED 399 per month) subject to notifying the Customer via Etisalat’s communication channels and securing the Customer’s explicit consent.
For Customers subscribing to the Home Wireless Premium Tariff Plan: the Charges (AED 299 per month) shall be valid for the duration of the Minimum Term (i.e. twenty-four (24) months). After the expiry of the Minimum Term the higher Tariff Plan price shall apply (AED 399 per month) subject to notifying the Customer via Etisalat’s communication channels and securing the Customer’s explicit consent.
(e) Promotion
i. New Customers
For Home Wireless Premium Promotion plan: The Promotion price (AED 299 per month) is valid for the duration of the Minimum Term (i.e. twenty-four (24) months). After the expiry of the Minimum Term the higher Tariff Plan price shall apply (AED 399 per month) subject to notifying the Customer via Etisalat’s communication channels and securing the Customer’s explicit consent. The Customer will receive a STARZPLAY voucher by email based on his/ her tariff plan, at the Customer’s email address that is associated with his/ her profile in Etisalat. The voucher can be redeemed by the Customer at the STARZPLAY app or webpage. The Customer will receive 3 Months GoChat Premium subscription as part of the Promotion.
ii. Existing Customers
For existing Home Wireless Premium plan (formerly Home Wireless 5G plan) Customers will enjoy three (3) months of unlimited data commencing at the Promotion Period.
(a) Transfer of ownership is not allowed.
(b) A request from the Customer to migrate a Service account or vary their subscription to the Service shall be deemed to be an authorization to Etisalat to transfer all of the Customer’s credits, dues and obligations in relation to the Service to the new account or to apply them to the varied subscription.
(c) Please see Clause 16 of the General T&Cs (Consumer) as applicable, for the other customer credit, advance payment and deposit provisions that apply to the Service.
Please see Clause 19 of the General T&Cs (Consumer) as applicable, for the provisions governing the suspension, disconnection and termination of the Service or the Agreement by Etisalat.
(a) If the Customer wants to terminate the Service, he/she must give Etisalat prior written notice.
(b) The Customer acknowledges that, upon receipt of the Customer’s termination notice, Etisalat shall terminate the Service.
(c) Where the Customer has selected a plan with a Minimum Term and terminates the Service before the expiry of this Minimum Term, the Customer shall pay an early termination charge, which shall amount to AED 1,000 or one undiscounted monthly rental Charge of the current plan, which amounts to AED 399 for the Home Wireless Advance plan or AED 399 for the Home Wireless Premium plan (whichever is the lower) and shall pay for the router as per the following calculation:
• ( Rp / Ct ) x ( Ct – ( 1 + T ) )
• Rp = the retail price of the device(s);
• Ct = the number of months in the Minimum Term of the contract; and
• T = the number of months the Customer has served in the contract.
(d) Penalty-Free Service Cancellation Period: the Customer may, subject to certain conditions being met, cancel the:
i. Home Wireless Advance plan within three (3) days in case the Customer opted out from receiving a router; or
ii. Home Wireless Advance plan within seven (7) days in case the Customer opted in to receive a router; or
iii. Home Wireless Premium plan within fourteen (14) days and Etisalat will waive the exit charges and/ or equipment charges as applicable. The router is to be returned to Etisalat with all accessories and documentation in its original packaging. The Customer can return the router, as the case may be, by calling “101” or “800101” to request Etisalat agents to collect the router.
(e) If at any time the Customer cannot be connected to a 5G network, the Customer will be automatically connected to a 4G network.
(a) Tariff Plans – FUP
i. Home Wireless Advance Tariff Plan
New Customers
New Home Wireless Advance Tariff Plan Customers acknowledge that the Service is subject to a FUP after the expiry of the Minimum Term and the following restrictions and/ or limitations in respect of the use of the Service and any add-on services shall apply: Etisalat reserves the right to throttle the speed of the Service to 1Mbps on either of the plans if the Customer exceeds 5TB of data usage in a month.
Existing Customers
For existing Home Wireless Advance Tariff Plan Customers (formerly Home Wireless 4G plan), the FUP shall apply i.e. by throttling the speed to 1Mbps in case the Customer exceeds 300 GB of data usage in a month.
ii. Home Wireless Premium Tariff Plan
New Home Wireless Premium Tariff Plan Customers acknowledge that the Service is subject to a FUP after the expiry of the Minimum Term and the following restrictions and/or limitations in respect of the use of the Service and any add-on services shall apply: Etisalat reserves the right to throttle the speed of the Service to 1Mbps on either of the plans if the Customer exceeds 1000GB of data usage in a month.
(b) Promotion - FUP
i. New Customers
New Home Wireless Premium Promotion Customers acknowledge that the Service is subject to a FUP after the expiry of the Minimum Term and the following restrictions and/ or limitations in respect of the use of the Service and any add-on services shall apply: Etisalat reserves the right to throttle the speed of the Service to 1Mbps on the plan if the Customer exceeds 5TB of data usage in a month.
ii. Existing Customers
Existing Home Wireless Premium Tariff Plan Customers (formerly Home Wireless 5G plan) after the Promotion Period, the FUP as applicable prior to the Promotion shall apply i.e. by throttling the speed to 1Mbps in case the Customer exceeds 1000 GB of data usage in a month.
The Customer may contact Etisalat to discuss the Service (including these Service Specific Terms and the General T&Cs (Consumer) or any other product or service offered by Etisalat, by using any of the communications channels stated in Clause 30 of the General T&Cs (Consumer).
Please see Clause 32 of the General T&Cs (Consumer) as applicable, for the provisions governing Value Added Tax (VAT) that apply to the Service.
