These terms of use (the “Terms”) constitute a legally binding agreement between you and Emirates Telecommunication Group Company PJSC together with its affiliates, subsidiaries and content provider partners (“Etisalat”, “we”, “our” or “us”), the TV service, website(s), browser extensions, and/or mobile applications for mobile devices (the “Site”) (collectively the “Service”). The Service is only available in the United Arab Emirates (the “Jurisdiction”). By accessing or using the Service, you signify that you have read, understood, and agree to be bound by this Terms of Use Agreement (“Agreement”), the General Terms and Conditions of Etisalat at www.etisalat.ae/termsandconditions and to the collection and use of your information as set forth in the Etisalat Privacy Policy at www.etisalat.ae/privacypolicy whether or not you are a registered user of the Service. This Agreement applies to you, and all other visitors, users, and others who access the Service from time to time (“Users”).

As part of the Service, we may offer paid monthly subscriptions (a ”Subscription”) or paid rentals (a “Rental”) to features of the Service that allow Users to access and Stream video Content on a subscription video on-demand (SVOD) and/or transaction video on-demand (TVOD) basis (“eLife OnDemand”). By using the Service, you expressly agree to the eLife OnDemand Services Terms and Conditions set forth in this Section (“Terms”). If you do not agree to, or wish to abide by these Terms, you may not continue to access or use the Service, and you must immediately cease any and all use of the Service.

Intellectual Property. (a) As between you and Etisalat, the Service, the Site and the Content are all owned and/or controlled under license by us, our licensors and content and technology providers, and are all protected by applicable domestic and international copyright laws. As used herein, "Content" means: (1) any and all motion pictures, programming, and any other audio visual content, images, animations, artwork, copy or information; and (2) any and all other human readable audio and/or visual elements, regardless of the form or format, accessible via the Services. (b) Etisalat, eLife, eLife Video Packs, eLife OnDemand, eLife OnDemand Basic, eLife OnDemand Platinum, eLife OnDemand Extreme Sports, eLife OnDemand Box Office and all registered and/or unregistered trade marks, trade names, and/or service marks provided by Etisalat on behalf of an affiliate, subsidiary or partner are the property of Etisalat and/or its affiliates, subsidiaries and partners. Certain characters, logos, names and images incorporated by us on the Site and/or the Content are also protected as registered or unregistered trade marks, trade names and/or service marks and are the property of their respective owners. The Marks may not be used without our express permission.

Content Ratings and Classification. content available on the service is rated according to guidelines established by television ratings/content authorities or advisories. however, some content may not be rated, and may contain graphic violence, sexual content and mature themes. such content may not be suitable for all viewers. etisalat also disclaims responsibility for any type of content provided on the service that has been provided to us from affiliates, subsidiaries, content providers and/or partners.

Streaming Content. Accessing the Content available on the Service for any purpose or in any manner other than Streaming (as defined below) is expressly prohibited. “Stream” or “Streaming” means a contemporaneous digital transmission of an audiovisual work via the Internet or a Network from the Service to a User’s device in such a manner that the data is intended for real-time viewing and not intended to be copied, stored, permanently downloaded, or redistributed by the User.

Territory: Means the State of the United Arab Emirates.

Recurring Subscription and/or Rental. By registering for the Service, you agree to the pricing terms as presented to you, and we may update them from time to time. You agree to pay all fees due for your Subscription to the Service (“Subscription Fees”) and/or Rental of the Service (“Rental Fees”) along with your Etisalat bill (unless you participate in a free trial or other Promotion as provided below), and you hereby authorize us to charge your Payment Method (as defined below) for all such Fees as and when they fall due.

No Commitment. There is no long term commitment or fixed term contract for eLife OnDemand Subscriptions. You may cancel this Agreement and thereby your Subscription to the Service via the Etisalat Call Centre on 800101 or an Etisalat Business Centre before a Renewal Date and before your next month of Subscription is due to start, and when you cancel it, you’ll continue to have access to the Service until the end of the month you’ve paid for or you are receiving free as part of a Promotion. There are NO REFUNDS OR CREDITS for cancellation, unless required otherwise by applicable law.

Payment Method, Charges, and Taxes. All information that you provide in connection with a purchase or transaction or other monetary transaction interaction with the Service must be legitimate, accurate, complete, and current. You agree to pay all charges incurred by you and/or any other user of your credit card, debit card or other payment method used in connection with a purchase or transaction or other monetary transaction interaction with the Service (“Payment Method”) at the prices in effect when such charges are incurred. You will pay any applicable taxes and other fees, if any, whether now applicable or applied in the future, relating to any such purchases, transactions or other monetary transaction interactions.

Subscription Promotions. We may, at our sole and absolute discretion, offer free trial periods of a Subscription and/or other promotions in connection with the Service (“Promotion(s)”). In the event a Subscription Promotion is offered to you, you can try the Service before you buy for a pre-determined period, depending on that particular offer or trial period. We only allow one Promotion per Subscription, household, telephone number, Payment Method, name, or alter-ego, and we reserve the right to prevent you from taking advantage of such Promotion if we think you have already had it or any other Promotion.

Disclaimer of Warranties. the service is provided on an “as is” and “as available” basis. use of the service is at your own risk. to the maximum extent permitted by applicable law, the service is provided without representations and/or warranties of any kind, whether express or implied.

limitation of liability to the maximum extent permitted by applicable law, in no event shall etisalat, its affiliates, subsidiaries, partners, agents, directors, employees, suppliers be liable for any direct, indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data or other intangible losses, that result from the use of, or inability to use, the service.

The Service is provided and operated by Etisalat as a Licensee from its facilities, only in the United Arab Emirates. We are not responsible for and make no representations that the Service is appropriate or available for use in other jurisdictions outside UAE. Those who access or use the Service from other jurisdictions including from within any other Service Location do so at their own volition, risk and are entirely responsible for compliance with all applicable local laws and regulations.

Governing Law. This Agreement will be governed by the laws of the United Arab Emirates. Any action brought by you arising out of or relating to this Agreement may be brought exclusively via United Arab Emirates courts and you irrevocably consent to the jurisdiction of such courts and venue.
